Division of joint property
The division of joint property means dividing property between those who are married to each other. In most cases, you will make a division of joint property if you are getting divorced. You can also make a division of joint property during marriage, if you both agree to this.
- If you make a division of joint property because you are getting divorced, you must first submit a petition for divorce to the district court.
- If you want to make a division of joint property during marriage, you must first submit a notify the Swedish Tax Agency.
- Regardless of whether you are dividing joint property because you are getting divorced or during marriage, you can yourselves choose whether or not you want to register the division of joint property document with the Tax Agency.
The Tax Agency is responsible for registering division of joint property documents and notifications of divisions of joint property. If you need help in drawing up the division of joint property document itself or a notification of division of joint property, you can turn to a lawyer.
Dividing joint property because you are getting divorced
If you are dividing joint property because you are getting divorced, you must submit a petition for divorce to the district court before you write the division of joint property document.
Dividing joint property during marriage
If you want to divide joint property during marriage, you must notify the Swedish Tax Agency that you intend to make a division of joint property before you can write the division of joint property document.
Do the following to register the division of joint property:
- Write a notification to the Tax Agency that you wish to divide joint property during marriage. There is no special form for this.
- Write your personal identity numbers on the notification so that the Tax Agency can identify you.
- Sign the notification (both spouses).
- Pay the fee for the notification of SEK 275 to the Tax Agency’s bankgiro account 227-5782. State only personal identity numbers as a payment reference.
- Send the original of the notification to

When the Tax Agency has received your notification of division of joint property, you can proceed with the division of joint property. For this reason, wait a couple of days before writing the division of joint property document so that the Tax Agency has time to receive your notification. When we have received the notification and registered it, we announce (advertise) it in the Official Swedish Gazette.
Register the division of joint property document
Regardless of why you have divided joint property, you can if you wish submit the division of joint property document to the Swedish Tax Agency for registration.
Do the following if you want to register your division of joint property document:
- Write the division of joint property document.
- Sign the division of joint property document (both spouses).
- Pay the application fee for registering the division of joint property document of SEK 275 to the Swedish Tax Agency’s bankgiro account 227-5782. State only personal identity numbers as a payment reference.
- Send the original of the division of joint property document to
